BICYCLE ACCIDENTS

DIMINISHED VALUE

A Diminished Value Claim arises in a situation in which you are involved in an accident that is not your fault and the at-fault party’s insurer is paying for the repairs to your vehicle. In addition to reimbursement for your rental expenses and loss of use, the at-fault party is responsible for paying the difference in value of your vehicle from the day before the accident to the day after the accident.

CRS 10-3-1115 creates a legal obligation for insurance companies to behave “reasonably” in first party claims. If an insurer acts unreasonably, you may be entitled to double damages and attorney’s fees. If an insurer acts unreasonably, you may be entitled to additional damages and attorney's fees.
