John Mattey is a personal injury attorney with over 25 years of experience helping accident victims and individuals and corporations resolve insurance claims. Prior to law school, Mr. Mattey worked as an insurance claims adjuster. After law school, he worked for a number of insurance companies adjusting claims and eventually supervising claims in litigation. Mr. Mattey also spent time with an insurance defense firm representing insurance companies. Mr. Mattey prides himself on his ability to listen and understand and appreciate his client’s goals and objectives. He describes his practice approach as client centric – basically focusing on the individual rather than just a case file. This approach includes talking to the client, understanding their situation and finding ways to help them get through the process. A Diminished Value Claim arises in a situation in which you are involved in an accident that is not your fault and the at-fault party’s insurer is paying for the repairs to your vehicle. In addition to reimbursement for your rental expenses and loss of use, the at-fault party is responsible for paying the difference in value of your vehicle from the day before the accident to the day after the accident.

CRS 10-3-1115 creates a legal obligation for insurance companies to behave “reasonably” in first party claims. If an insurer acts unreasonably, it may be reasonable for double damages and attorney’s fees for its conduct. If an insurer acts unreasonably, you may be entitled to additional damages and attorney's fees.
